Introduction
This legislation adds a new regulation 25 to the Control of Fireworks and other Explosives Regulations. This regulation prohibits the use of all pyrotechnics in indoor public spaces, including those pyrotechnics placed in category F1 in the Placing on the Market of Pyrotechnic Articles Regulations.
Due exception is made for the use of pyrotechnics in such indoor public spaces by persons with specialist knowledge (as indicated in the Placing on the Market of Pyrotechnic Articles Regulations) who are in possession of a licence issued in terms of the Explosives Ordinance or its subsidiary legislation.
The penalty for offences against this regulation is a fine of not less than EUR 120 and not more than EUR 350.
Target Audience
The entertainment industry, clubs (każini), including catering, and importers/retailers.
When do these rules apply?
The rules enter into force two (2) months after publication.
What is required for compliance?
Entertainment establishments should not provide sparklers, or similar items, for use indoors. Moreover, they should not permit the use of such items indoors.
Retailers are encouraged to inform consumers that sparklers and similar items may not be used in indoor public spaces.
